Welcome to SugarSkin! These Terms and Conditions ("Terms") govern your use of our website at bysugarskin.com (the "Site") and your purchase of products from Sugar & Stix LLC ("SugarSkin," "we," "us," or "our").

By accessing or using our Site and placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site or purchase our products.

1. Acceptance of Terms

By creating an account, making a purchase, or using our Site in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other policies referenced herein.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms.

You must be at least 18 years old to make a purchase on our Site. By placing an order, you represent and warrant that:

Pricing

• All prices are in U.S. Dollars (USD) and are subject to change without notice
• Prices do not include shipping costs or sales tax (added at checkout)
• We reserve the right to modify prices at any time
• Price changes do not affect orders already placed

Discount Codes

• Discount codes cannot be combined unless explicitly stated
• Codes are valid for specified periods and subject to terms and conditions
• We reserve the right to cancel or modify discount codes at any time
• One discount code per order unless otherwise specified

5. Pre-Orders

Payment

• Your credit card will be charged immediately when you place a pre-order
• Payment is required upfront to secure your order and reserve inventory
• Charges will appear on your statement as "SugarSkin" or "Sugar & Stix LLC"

Ship Date

• Pre-orders will ship on or around December 15, 2025
• You will receive a shipping notification with tracking information when your order ships
• Ship dates are estimates and may be subject to change due to production delays
• We will notify you of any significant delays

Cancellations

• Pre-orders may be cancelled within 24 hours of placement for a full refund
• After 24 hours, pre-orders cannot be cancelled as production has begun
• To cancel within the 24-hour window, email hello@bysugarskin.com

Changes to Pre-Orders

• You may modify your shipping address up until 48 hours before the ship date
• Product changes or additions require a new order
• Contact us at hello@bysugarskin.com for address updates

6. Order Acceptance and Processing

Your order represents an offer to purchase our products. We reserve the right to:

• Accept or decline any order for any reason
• Limit quantities per order or per customer
• Cancel orders that appear fraudulent or suspicious
• Refuse service to anyone at our discretion

Receipt of an order confirmation email does not constitute acceptance of your order. We accept your order when we ship the products or send a shipment confirmation email.

7. Payment

• Processing time for pre-orders: Ships December 15, 2025
• Standard shipping takes 3-7 business days after shipment

• Risk of loss passes to you upon delivery to the carrier

9. Returns and Refunds

• Returns accepted within 30 days of delivery
• Products must be unopened and in original condition
• Opened products cannot be returned due to hygiene standards
• Refunds processed within 5-7 business days after receiving returned items
• Customer responsible for return shipping costs (unless defective)

10. Product Use and Safety

Intended Use

Our products are cosmetic skincare products intended for external use only:

• For external use only
• Avoid contact with eyes
• Discontinue use if irritation occurs
• Keep out of reach of children
• Store in a cool, dry place away from direct sunlight

Patch Test Recommendation

We recommend performing a patch test before first use:

1. Apply a small amount to the inside of your wrist or elbow
2. Wait 24 hours
3. If no irritation occurs, the product is likely safe for use
4. If irritation develops, discontinue use

• Allergic reactions or skin irritation (beyond product refund)
• Delays in shipping or delivery
• Unauthorized access to your account

Our total liability to you for any claim arising from your use of our Site or products shall not exceed the amount you paid for the specific product giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Sugar & Stix LLC from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Informal Resolution

Before filing any legal action, we encourage you to contact us at hello@bysugarskin.com to resolve the issue informally. Most disputes can be resolved quickly and amicably through direct communication.

Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in Hernando County, Florida.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Jurisdiction

For any matters not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Hernando County, Florida.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver shall be effective unless in writing and signed by an authorized representative of Sugar & Stix LLC.

18. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and Sugar & Stix LLC regarding your use of the Site and purchase of products.

19. Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to:
